Este supuesto se conoce como sucesi\u00f3n intestada y est\u00e1 regulado en el <strong>C\u00f3digo Civil<\/strong> y, en algunos casos, en las legislaciones auton\u00f3micas de territorios con derecho civil propio.<\/p>\n\n\n\n<p>En primer lugar, heredan los <strong>hijos y descendientes<\/strong>. Si alguno de ellos ha fallecido, sus propios hijos (los nietos del causante) heredan en su lugar. Esto garantiza que la herencia siempre pase en primer t\u00e9rmino a la l\u00ednea descendente.<\/p>\n\n\n\n<p><strong>Si no hay descendientes<\/strong>, la herencia corresponde a los padres y ascendientes. En caso de que los padres ya hayan fallecido, pueden heredar los abuelos u otros ascendientes m\u00e1s lejanos.<\/p>\n\n\n\n<p>Cuando no existen ni descendientes ni ascendientes, la ley otorga el derecho de heredar al c\u00f3nyuge viudo, siempre que no estuviera separado legalmente o de hecho en el momento del fallecimiento.<\/p>\n\n\n\n<p>Si tampoco hay c\u00f3nyuge, los siguientes llamados a heredar son los hermanos y sobrinos del fallecido. Los hermanos heredan a partes iguales y, en caso de haber fallecido alguno, sus hijos (los sobrinos) heredan en su lugar.<\/p>\n\n\n\n<p>A falta de hermanos y sobrinos, se recurre a los dem\u00e1s parientes colaterales hasta el cuarto grado de consanguinidad, lo que incluye a los primos, sobrinos-nietos y t\u00edos-abuelos.<\/p>\n\n\n\n<p><strong>Finalmente<\/strong>, si no existen herederos en ninguno de estos grupos, la herencia pasa al Estado, que destina los bienes a fines de inter\u00e9s general, respetando el procedimiento legal establecido.<\/p>\n\n\n\n<p>En resumen, cuando no hay testamento, la ley ordena de forma estricta qui\u00e9n hereda, dando siempre preferencia a los familiares m\u00e1s cercanos.
